Shipping:
Shipment can be arranged through Clarke & Co., Inc. through local third party affiliates with experience in the transportation of live trees. The utmost care shall be taken to load and handle the trees properly, however shipments travel at the expense and risk of the purchaser. Where damage or delay occurs in shipment, claims should be made at once.
Warranty:
Clarke & Co., Inc. warrants all varieties shipped true to name and will replace on proper proof all that may prove otherwise. Clarke & Co., Inc. gives no warranty, expressed or implied as to life, description, quality, productiveness or any other matter of any nursery stock or plants that we sell. It is mutually agreed that our total liability for any error, should stock prove untrue to name as labeled, shall be limited upon satisfactory proof, to our replacing free or refunding the purchase price thereof. We accept orders subject to crop conditions, error in counts, and with the understanding that the same shall be void should injury befall the stock due to hail, fire, frost, or other causes beyond our control.
Claims:
Reports of any damage or unsatisfactory stock must be made in writing within five (5) days from receipt of shipment.
Terms:
Our regular terms are cash or check. Established companies may request credit by completing an application. With approved credit, payment on accounts is due 30 days from billing. A late payment charge of 1 1/2% per month (18% annually) or $5.00 minimum per month plus cost of collection will be assessed on past due accounts.
Discounts:
2% discount if trees are paid for within 30 days of billing.
